What units stay in a gifted base?

When you transfer a base to some faction, some of your units are moved to your nearest base, and some are gifted and stay. What rules apply to sorting out former from the latter? All I heard is attackers leave, defenders stay. Does somebody know exactly? Does the behavior depend on whether base is sold, gifted, relinquished on demand, conquered and returned on demand? Is diplomatic status with the receiver relevant?
